Do I Need a Privacy Policy?
In Canada (PIPEDA)
Under Canada's Personal Information Protection and Electronic Documents Act (PIPEDA), any private-sector organization that collects, uses, or discloses personal information in the course of commercial activity must have a privacy policy. Ontario businesses are also subject to provincial privacy guidelines.
In the EU (GDPR)
The General Data Protection Regulation requires any business that processes personal data of EU residents to provide a clear privacy notice, regardless of where the business is located. Non-compliance can result in fines up to €20 million or 4% of global turnover.
In the US (CCPA)
California's Consumer Privacy Act applies to businesses that collect data from California residents. Most US states are following with their own privacy laws. Even if not legally required, a privacy policy builds customer trust and is required by platforms like Google and Apple.
Best Practices
Keep your privacy policy current — update it when you add new data collection, new third-party services, or change your retention practices. Review it annually at minimum. Always display it prominently in your website footer and at signup forms.
